{"id":8840,"date":"2024-01-11T18:33:00","date_gmt":"2024-01-11T16:33:00","guid":{"rendered":"https:\/\/tech4access.com\/?p=8840"},"modified":"2024-12-05T15:26:49","modified_gmt":"2024-12-05T13:26:49","slug":"rgaa","status":"publish","type":"post","link":"https:\/\/tech4access.com\/en\/rgaa\/","title":{"rendered":"What is the RGAA and why should your website and application comply with it?"},"content":{"rendered":"\n<p>At the beginning of 2005, <strong>France adopted Law No. 2005-102 aimed at guaranteeing access to IT tools for all users<\/strong>, in particular disabled people.<\/p>\n\n\n\n<p>This is the origin of the <a href=\"https:\/\/disic.github.io\/rgaa_referentiel_en\/rgaa-companion-guide.html#2.7.1\" target=\"_blank\" rel=\"noreferrer noopener\">R\u00e9f\u00e9rentiel G\u00e9n\u00e9ral d&#8217;Accessibilit\u00e9 pour les Administrations (RGAA)<\/a>, <strong>the web accessibility directive in France<\/strong>. This Directive sets out the regulatory guidelines to be followed and provides a verification method for the accessibility of the websites concerned, and the subjects that must comply with the digital accessibility laws.<\/p>\n\n\n\n<p>The RGAA, currently in version 4.1, is based on the <a href=\"https:\/\/www.w3.org\/TR\/WCAG21\/\" target=\"_blank\" rel=\"noreferrer noopener\">WCAG 2.1<\/a><strong> guidelines and the EN 301 549, the European technical standard,\u00a0 and includes certain additional accessibility requirements<\/strong>, such as unit testing and the publication of an accessibility declaration.<\/p>\n\n\n\n<p><strong>It is a way of ensuring that Information Technology (IT) services<\/strong>, particularly websites and web-based applications, are accessible to everyone, including disabled users.<\/p>\n\n\n\n<p>These standards aim to eliminate barriers to digital accessibility, <strong>enabling everyone to exercise their right to access services and public information <\/strong>using new technologies.<\/p>\n\n\n\n<p><strong>Technological developments have reinforced the need to bridge the digital divide<\/strong>, in compliance with national and international standards, as well as web accessibility standards.<\/p>\n\n\n\n<p>For this reason, <strong>it is essential to take compliance with the requirements and recommendations issued by the competent <\/strong>web accessibility <strong>bodies seriously<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who must comply with the RGAA?<\/h2>\n\n\n\n<p><strong>Digital accessibility is part of an equality approach that must guarantee the fundamental right of disabled people <\/strong>to access digital information and services.<\/p>\n\n\n\n<p><strong>In France, digital accessibility is mandatory and is governed by two main texts:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Article 47 of the so-called &#8220;Disability Act&#8221; of 11 February 2005.<\/li>\n\n\n\n<li>The Implementing Decree of 24 July 2019, on the accessibility of online public communication services for people with disabilities, which sets out the legal obligations in terms of digital accessibility.<\/li>\n<\/ul>\n\n\n\n<p>These texts define the entities subject to the legal obligations of digital accessibility, <strong>the relevant digital services and the penalties for non-compliance with the law<\/strong>.<\/p>\n\n\n\n<p><strong>As a result, the RGAA applies to a number of very important segments of society:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legal entities governed by public law: <\/strong>the State, local authorities, public establishments, etc.<\/li>\n\n\n\n<li><strong>Legal entities to which a public service mission is delegated or which have a mission of general interest: <\/strong>public transport companies, water and sanitation companies, tourist offices, cultural structures, etc.<\/li>\n\n\n\n<li><strong>Private companies with sales in excess of \u20ac250 million generated in France and calculated on the basis of the average of the previous three years<\/strong>. This amount is defined by the implementing decree of 24 July 2019.<\/li>\n<\/ul>\n\n\n\n<p>This highlights <strong>a compliance obligation specifically applied to public sites<\/strong> and sites of public interest.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Web accessibility requirements in accordance with Decree no. 2019-768 of 24 July 2019<\/h2>\n\n\n\n<p>The Act establishes <strong>the following requirements to ensure full access to information <\/strong>and services by removing barriers to accessibility on the net, promoting:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>RGAA compliance for websites and mobile applications.<\/li>\n\n\n\n<li>Declaration of accessibility.<\/li>\n\n\n\n<li>Setting up dedicated contact and support facilities for users within a reasonable timeframe.<\/li>\n\n\n\n<li>Mandatory mention of RGAA compliance status on the home page.<\/li>\n\n\n\n<li>Publication of a multi-annual accessibility plan for a maximum of 3 years. This is a roadmap setting out the entity&#8217;s policy on digital accessibility and detailing the resources deployed.<\/li>\n<\/ul>\n\n\n\n<p>It is important to emphasise that <strong>the legal requirements for digital accessibility apply to all websites:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Internet, intranet and extranet sites.<\/li>\n\n\n\n<li>Mobile applications.<\/li>\n\n\n\n<li>Web-based software.<\/li>\n\n\n\n<li>Digital street furniture (e.g. interactive terminals).<\/li>\n\n\n\n<li>Content (including PDF documents and videos).<\/li>\n\n\n\n<li>Penalties for breaches.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Compliance with the RGAA over time<\/h2>\n\n\n\n<p>The laws are in force, and <strong>all the entities concerned by the legal obligation must comply with the legal obligations of digital accessibility<\/strong>.<\/p>\n\n\n\n<p><strong>The compliance deadlines laid down in the decree have already passed<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are the penalties for non-compliance and the benefits of compliance?<\/h2>\n\n\n\n<p>If <strong>the RGAA compliance <\/strong>status <strong>of the site or application is not displayed on the home page<\/strong>, an annual administrative penalty will be imposed.<\/p>\n\n\n\n<p>The amount of this penalty is set by <strong>Article 8 of Decree no. 2019-768 of 24 July 2019<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Municipalities with fewer than 5,000 inhabitants <strong>are fined \u20ac2,000 <\/strong>for each offence detected.<\/li>\n\n\n\n<li><strong>Fines of \u20ac20,000 <\/strong>for other entities involved in the infringement.<\/li>\n<\/ul>\n\n\n\n<p>However, <strong>it is important to stress that the rigour of the regulations is due to the fact that the accessibility <\/strong>of mobile applications and websites benefits the whole of society, not just people with disabilities.<\/p>\n\n\n\n<p>Complying with the law also <strong>displays corporate responsibility and social consciousness <\/strong>, while complying with legal obligations.As well as being <strong>a responsibility shared by public and private players<\/strong>, this brings significant benefits for society as a whole.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is the best way to comply with the RGAA?<\/h2>\n\n\n\n<p>At <a href=\"https:\/\/tech4access.com\/en\/\" target=\"_blank\" rel=\"noreferrer noopener\">Tech4access<\/a>, we have developed the <a href=\"https:\/\/tech4access.com\/en\/sia-comprehensive-digital-accessibility-service\/\" target=\"_blank\" rel=\"noreferrer noopener\">SIA\u00ae (Service for Integrated digital Accessibility)<\/a>. <strong>In many countries, this service has become the benchmark for providing <\/strong>total <strong>digital accessibility <\/strong>for a website or mobile application, while guaranteeing compliance with national and international standards.<\/p>\n\n\n\n<p><strong>That&#8217;s why SIA\u00ae is the recommended service for complying with the RGAA<\/strong>, the perfect opportunity to get advice on how to align yourself with the legal requirements.
