{"id":8186,"date":"2023-08-18T11:48:00","date_gmt":"2023-08-18T09:48:00","guid":{"rendered":"https:\/\/tech4access.com\/?p=8186"},"modified":"2024-11-14T13:19:13","modified_gmt":"2024-11-14T11:19:13","slug":"stanca-law-accessibility","status":"publish","type":"post","link":"https:\/\/tech4access.com\/en\/stanca-law-accessibility\/","title":{"rendered":"What is the italian &#8216;Stanca Law&#8217; on accessibility and why must your website and app comply with it?"},"content":{"rendered":"\n<p>In January 2004, the  italian <a href=\"https:\/\/www.engage.hoganlovells.com\/knowledgeservices\/news\/digital-accessibility-in-italy-agid-sheds-light-on-the-stanca-law\" target=\"_blank\" rel=\"noreferrer noopener\">Law of 9 January no. 4<\/a> <strong>also known as the &#8216;Stanca Law&#8217;<\/strong>, with the aim of <strong>guaranteeing access to IT tools to all users<\/strong>, in particular people with disabilities.<\/p>\n\n\n\n<p>This regulation <strong>ensures that Information Technology (IT) services<\/strong>, in particular websites and web-based applications, are accessible to everyone, including people with disabilities.<\/p>\n\n\n\n<p>This law <strong>focuses on removing physical, cognitive and sensory barriers, enabling everyone to exercise their right to access public services and information <\/strong>through new technologies.<\/p>\n\n\n\n<p>It also serves as a reminder that <strong>technological evolution has accelerated the need to bridge the digital divide<\/strong>, complying with national and international regulations and web accessibility standards.<\/p>\n\n\n\n<p>For this reason, <strong>it is essential to seriously address the issue <\/strong>of compliance with the requirements and recommendations issued by the competent authorities on web accessibility.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who has to comply with the Stanca Law?<\/h2>\n\n\n\n<p>According to the Stanca Law, an Information Technology (IT) service or website is considered &#8216;accessible&#8217; when it offers user-friendly methods of access.<\/p>\n\n\n\n<p>This is achieved through efficient content creation and structure, as well as the presentation and operation of interfaces, allowing the same information to be obtained through different sensory modalities, <strong>regardless of the device used to access the platform<\/strong>.<\/p>\n\n\n\n<p><strong>All this to ensure accessibility through an inclusive and versatile experience for all users<\/strong>, regardless of their abilities or specific needs.<\/p>\n\n\n\n<p>Therefore, <strong>the Stanca Law applies to various crucial sectors of society, including<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>&nbsp;Public administrations.<\/li>\n\n\n\n<li>Economic public bodies.<\/li>\n\n\n\n<li>&nbsp;Private companies concessionaires of public services.<\/li>\n\n\n\n<li>Public assistance and rehabilitation organisations.<\/li>\n\n\n\n<li>Transport and telecommunications companies with a predominantly public capital participation.<\/li>\n\n\n\n<li>Municipal, provincial and regional authorities.<\/li>\n\n\n\n<li>IT service contractors.<\/li>\n<\/ul>\n\n\n\n<p>This <strong>&nbsp;sets forth specific compulsory requirements&nbsp; for public sites or sites of public interest<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Web accessibility requirements under the Stanca Law<\/h2>\n\n\n\n<p>The law <strong>establishes the<\/strong><a target=\"_blank\" href=\"https:\/\/premedia.it\/leggestanca.pdf\"><strong> <\/strong><\/a>following&nbsp; requirements<strong> to ensure full <\/strong>access <strong>to information and services <\/strong>by removing access barriers on the network by promoting:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Compliance with the guidelines required by AgID for websites and apps.<\/li>\n\n\n\n<li>Provide and periodically update a detailed, comprehensive and clear accessibility statement on the conformity of websites and mobile applications. This statement must include:<\/li>\n<\/ul>\n\n\n\n<p>o &nbsp; Indication of inaccessible parts of the content with justification and alternative solutions.<\/p>\n\n\n\n<p>o &nbsp; A feedback mechanism for users.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prohibition of contracts for the creation or modification of websites and mobile applications that do not comply with accessibility requirements.<\/li>\n\n\n\n<li>Adaptation of existing contracts to comply with accessibility requirements within twelve months from the date of publication of the guidelines.<\/li>\n\n\n\n<li>Provide hardware and software tools adapted to the specific disability of the disabled worker, including in the case of working remotely..<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Compliance with the Stanca Law over time<\/h2>\n\n\n\n<p>From <strong>2020, public administrations have to publish <\/strong>the <strong>accessibility goals of their websites<\/strong>, the declaration in European format, and then update them annually.<\/p>\n\n\n\n<p>From <strong>2022, this obligation was extended to private companies with an average turnover of more than EUR 500 million <\/strong>in the last three years.<\/p>\n\n\n\n<p>All companies that fit the above mentioned <strong>&nbsp;have until 2025 to comply with the accessibility requirements of in their digital products<\/strong>.
